USE POLICY

SCOPE OF APPLICATION

1.1 This regulation applies to all issues related to the use of the service between the service user and VivuCloud Project (Hereinafter referred to as “VivuCloud”).

1.2 These regulations may change at any time without prior notice, and when agreeing to use the service, the customer has unconditionally agreed to this change. The latest Vietnamese version is always updated here with information on the date of last update. Translated versions of other languages are for reference only.

WORDS EXPLANATION

In this regulation, the following words are understood in the meaning explained below:

2.1. “Service users” are agencies, organizations and individuals who have accepted these regulations and registered to use the service in accordance with the procedures prescribed by VivuCloud.

2.2. “Services” means all services that VivuCloud provides including Proxy Creation Software, Hosting, VPS, Servers, Proxies and other related services.

REGISTER AND USE THE SERVICE

3.1. General regulations for users:

3.1.1. We are not responsible for legal matters or any other responsibilities regarding the accuracy of stored information on our servers.

3.1.2. We are not liable for any legal responsibility or compensation for loss or damage to data stored on servers in cases caused by service users: accidental deletion, website errors, etc.

3.1.3. Users must self-manage all information and data stored on our servers and passwords on the customer portal. Immediately notify us when users detect unauthorized access using their account or security vulnerabilities, including loss, theft, or disclosure of password and other information.

3.1.4. Not allowed to store any information, data with content distortion, defamation, defamation, illegal violation, contrary to the political line of the Socialist Republic of Vietnam and other countries, and/or related to pornography, obscenity, fraud, violation of culture, national customs of Vietnam.

3.1.5. Not allowed to store any information, data directly or indirectly related to copyright infringement, intellectual property infringement, industrial property rights, hacking, cracking, warez, etc.

3.1.6. Not allowed to link to websites with information and data in sections 3.1.4 and 3.1.5.

3.1.7. Users must be legally responsible for the content of their websites and must accept any form of processing from competent authorities (if any) if the content violates the laws of the Socialist Republic of Vietnam.

3.1.8. Do not use programs capable of congesting or slowing down the system, such as depleting system resources, overloading CPUs, and memory.

Important: Unmetered bandwidth is considered as fair use and not guaranteed. We do not allow applications and use cases such as torrent seeding, CDN nodes, "DDoS proxies", commercial/public proxy/VPN tunnels, or blockchain nodes. This may result in account termination.

3.2. Proxy Creation Tool Service:

3.2.1. Do not use the Proxy Creation Tool to create proxies for illegal purposes or to affect internet users.

3.2.2. By using the proxy creation tool, you implicitly accept and carefully read our usage instructions for the proxy creation tools we provide.

3.2.3. Keys will be deleted on Tuesdays or Wednesdays after expiration.

3.2.4. VivuCloud will not be legally liable and will not compensate for any losses or damages caused by users not reading the usage instructions/videos before using the tool.

3.3. Hosting Service:

3.3.1. Comply with the general regulations for users as stated in section 3.1.

3.3.2. Users are responsible for the content of emails sent from their account's mailbox.

3.3.3. Users of the hosting service must not use it to send SPAM, ADVERTISING EMAILS, BULK MAIL, MASS MAIL, BOMB MAIL,... (from any source) related to websites hosted on our server system (sending 15 emails at the same time with the same content) or with the intention of sabotage from our server or network, not encouraging any site on the server to use bulk email. Users of the service must ensure that all emails sent comply with Vietnamese culture, laws, especially the Information Technology Law and are sent securely. The number of emails sent outside the internal network should not exceed 200 emails/day.

3.3.4. Users of the service must not hack bugs, bypass the check mechanism of the Hosting Control Panel or installed software on the server (such as apache, nginx, directadmin, cpanel, csf,...), only use as provided resources. We will temporarily block or delete accounts if users intentionally attempt.

3.3.5. Only use up to 1,000 tables/1 database and no more than 1GB capacity/1 database. The number of stored files on Hosting should not exceed 200,000 files.

3.3.6. For the Vbulletin Board (VBB) source code, customers are not allowed to install the following functions: Mod: VBSEO, Online members within 24 hours, Members posting within 24 hours, Cometchat, Shoutbox (If used, apply the following regulations: Guests are not allowed to use the shoutbox (Only members can see the shoutbox), The shoutbox shows a maximum of 10 lines, The shoutbox refresh time is at least 60 seconds, The number of emoticons (smiles) displayed in the shoutbox should not exceed 20).

3.4. Virtual Private Server (VPS), Server Service:

3.4.1. Comply with the general regulations for users as stated in section 3.1.

3.4.2. Users are responsible for the content of emails sent from their account's mailbox. 3.4.3. Users are responsible for the use of the IP address provided specifically for the virtual server or server service.

3.4.4. Users are responsible for installing software when using the service.

3.4.5. Do not excessively use CPU from activities such as cryptocurrency mining, CPU-intensive tools,... continuously exceeding 30% of the VPS's designated CPU, VivuCloud reserves the right to limit your CPU to maintain consistent service performance.

3.4.6. Do not excessively use bandwidth from activities continuously exceeding 10% of the bandwidth designated for the VPS, VivuCloud reserves the right to limit bandwidth to maintain consistent service performance.

3.5. Software Service:

3.5.1. We are only responsible for advising, designing according to requirements, and users of the service will be responsible for the usage of the software.

3.5.2. The content of the software must not distort, attack, defame, violate laws,... contrary to the political line of the Socialist Republic of Vietnam and other countries, or/and content related to pornography, obscenity, fraud,... violating the cultural traditions of the Vietnamese nation.

3.6. Other Services: Comply with the general usage regulations.

PAYMENT

4.1. Users of the service are responsible for making full and timely payments.

4.2. Within 24 hours from the time of service registration, if payment is not made, all registration information for using the service will be invalid. (for VPS)

4.3. During the stipulated period for service renewal, if payment is not made, the service will be revoked as per regulations.

4.4. We DO NOT have a refund policy for deposits made on our websites unless agreed upon in advance.

4.5. VivuCloud will not be liable for any losses or damages arising from delayed payments.

4.6. During the payment waiting period, if there are changes in pricing policies, VivuCloud reserves the right to cancel registration or change the pricing policy to be appropriate for the time the service is activated.

SECURITY OF CUSTOMER ACCOUNT INFORMATION

5.1. Users of the service are responsible for their login credentials, password, password management, changing passwords, and changing information - data related to the registered service and account managed by VivuCloud.

5.2. We will not be liable for any losses or damages arising from the negligence of service users in disclosing information.

TERMINATION, CANCELLATION OF SERVICE

6.1. In the event of any of the following situations, VivuCloud may terminate the contract without any notice or warning and may delete data registered by the service user or any information on the server. In the event that VivuCloud or a third party suffers damages due to any of the following activities caused by the service user, the service user is responsible for compensating VivuCloud or the third party.

6.1.1. If VivuCloud demonstrates that the service user has violated the specific terms and conditions of use of the service listed in detail.

6.1.2. If the registration procedures for this service are not conducted according to the procedures stipulated by VivuCloud and the law.

6.1.3. If the service user fails to meet the payment obligations for this service.

6.1.4. If the service user is a minor without the consent of a legal guardian, unless local laws apply or permit.

6.1.5. If the service user's use of this service seriously affects the operation of the service system.

6.1.6. If VivuCloud detects a competitor attempting to enter into a contract for the purpose of investigating or undermining VivuCloud's business.

6.1.7. If any unfavorable situations arise for VivuCloud due to the negligent or intentional acts of the service user.

6.1.8. If the operation of the service is obstructed.

6.1.9. If the service user deliberately posts false information about the service.

6.1.10. If IDs and passwords are used fraudulently.

6.1.11. If the service user or the user's staff is proven to belong to an anti-social group as a criminal organization.

6.1.12. If any terms of the terms are violated.

6.1.13. In any other cases where, according to its own criteria, VivuCloud determines that the service user's use is detrimental to VivuCloud or other users.

6.2. For any reason mentioned above for terminating this contract, VivuCloud shall not be liable for any legal consequences to the service user regarding the termination of the contract.

6.3. Upon discovering any violations by any customer of the above regulations, we may unilaterally terminate the contract or immediately cease to provide any services related to that customer without prior notice. We shall not be liable for any responsibility and shall not compensate for damages or refund fees.
